These Terms and Conditions ("Terms") govern your use of the services provided by Path2Well ("we," "us," or "our"), including genetic testing, IV therapy, and iron infusion services (collectively, the "Services"). Our Services are provided in Australia, comply with the Therapeutic Goods Administration (TGA) requirements and guidelines, and are intended for individuals aged 18 and over. By accessing or using our Services, you agree to be bound by these Terms. If you do not agree, please do not use our Services.
1. Our Services. Path2Well offers the following Services, subject to these Terms:
Genetic Testing: We facilitate genetic testing through our third-party laboratory partner, NutriPATH, a leading Australian integrative pathology laboratory. Tests analyse genetic markers to provide insights into health, wellness, and nutritional needs. Samples are collected at accredited collection centres or via approved home collection kits, as specified by NutriPATH.
IV Therapy: We provide intravenous (IV) therapy, including nutrient-rich infusions (e.g., vitamins, NAD+), administered by clinical health practitioners in a clinical or home setting. Treatments are personalised based on your health needs and medical consultation. All infusions use sterile products supplied by our pharmacy partner, Infinity Wellness Group SA.
Iron Infusion: We offer iron infusion services, including home-based infusions, to address iron deficiency. Home iron infusions are only provided if you have a recent blood panel (within the last 3 months) and a valid prescription from a licensed Australian doctor.
All Services are delivered in compliance with TGA requirements and guidelines, ensuring safety, efficacy, and quality.
2. Eligibility. To use our Services, you must:
Be at least 18 years old.
Reside in Australia.
Provide accurate and complete information during registration, consultations, or sample collection.
For iron infusions, provide a recent blood panel (within 3 months) and a valid doctor’s prescription for home-based services.
We reserve the right to refuse service to anyone who does not meet these criteria or fails to comply with these Terms.
3. Booking and Payment
Booking: Services must be booked through our website, mobile application, or by contacting us directly. You must provide accurate personal and medical information to ensure safe delivery of Services.
Payment: Fees for Services are payable at the time of booking unless otherwise agreed. Prices include GST and are quoted in Australian dollars (AUD). We accept major credit cards, bank transfers, and other approved payment methods.
Cancellations and Refunds: Cancellations made at least 48 hours before a scheduled appointment may be eligible for a full refund, less any administrative fees. No refunds are provided for cancellations within 48 hours or for no-shows, except as required by Australian Consumer Law. Genetic testing kits are non-refundable once dispatched, unless faulty or incorrectly supplied.
4. Service Delivery
Genetic Testing: You must follow NutriPATH’s instructions for sample collection (e.g., buccal swab, blood, or urine) and attend an accredited collection centre or use a provided home kit. Results are delivered via our secure portal or email, with interpretation provided by qualified practitioners. Delays in sample processing are subject to NutriPATH’s laboratory schedules.
IV Therapy: IV therapy is administered by clinical health practitioners in a sterile environment, either at a clinic or your home. You must complete a medical questionnaire and consultation to confirm suitability. Treatments are customised based on your health profile and practitioner recommendations.
Iron Infusion: Iron infusions are administered by clinical health practitioners using sterile products from Infinity Wellness Group SA. Home infusions require a recent blood panel and a valid prescription, which we verify before treatment. You must disclose any medical conditions or allergies to ensure safety.
TGA Compliance: All Services, including equipment, medications, and testing kits, comply with TGA regulations for safety and quality. IV therapy and iron infusion products are sourced from TGA-registered suppliers, including Infinity Wellness Group SA.
5. Your Responsibilities. You agree to:
Provide accurate, complete, and up-to-date personal and medical information.
Follow all instructions provided by Path2Well, NutriPATH, or our practitioners for sample collection, preparation (e.g., fasting), or treatment.
Disclose any medical conditions, allergies, or medications that may affect the safety or efficacy of our Services.
For home iron infusions, ensure a recent blood panel and valid prescription are provided before treatment.
Use our Services only for lawful purposes and in accordance with these Terms.
Failure to comply may result in delays, cancellation of Services, or health risks, for which we are not liable.
6. Risks and Limitations
General Risks: All medical procedures, including IV therapy and iron infusions, carry risks (e.g., allergic reactions, infection, or discomfort). We take all reasonable precautions, including using sterile equipment and TGA-approved products, to minimise risks.
Genetic Testing: Results may not provide definitive diagnoses and should be interpreted by a qualified practitioner. Genetic insights are based on current scientific knowledge and may change over time.
Home Services: Home-based IV therapy and iron infusions require a safe and suitable environment, which you must provide. We reserve the right to cancel or reschedule if conditions are unsafe.
No Guarantee: While we strive to deliver high-quality Services, we do not guarantee specific outcomes, as results depend on individual health factors and adherence to recommendations.
You acknowledge these risks and agree to discuss any concerns with your doctor or our practitioners before using our Services.
7. Privacy and Data Protection
Your personal and health information is handled in accordance with our Privacy Policy and the Australian Privacy Principles under the Privacy Act 1988 (Cth). Genetic testing data is processed by NutriPATH and shared with us only as necessary to deliver results. We use secure systems to protect your data, but you acknowledge that no system is entirely risk-free. For details, refer to our Privacy Policy.
8. Intellectual Property
All content, including test reports, branding, and materials provided through our Services, is owned by Path2Well or our partners. You may not reproduce, distribute, or modify this content without our written consent, except for personal use of your test results.
9. Third-Party Providers
NutriPATH: Genetic testing is conducted by NutriPATH, an independent laboratory. We are not responsible for delays, errors, or issues arising from NutriPATH’s processes, though we will assist in resolving concerns.
Infinity Wellness Group: Our sterile pharmacy partner supplies TGA-approved products for IV therapy and iron infusions. We are not liable for issues arising from their products, provided they meet TGA standards.
Collection Centres: Blood or sample collection may occur at accredited third-party centres. You must follow their procedures and present required forms.
10. Liability and Disclaimers
Limitation of Liability: To the maximum extent permitted by law, Path2Well is not liable for any indirect, consequential, or incidental damages arising from your use of our Services, including but not limited to loss of data, health complications, or financial loss. Our liability is limited to the amount paid for the Service, except as required by Australian Consumer Law.
Australian Consumer Law: Our Services come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a refund, replacement, or repair for a major failure and compensation for any reasonably foreseeable loss or damage. For minor issues, we may choose to provide a repair or replacement.
No Medical Advice: As stated in the Disclaimer, our Services and any related information (e.g., genetic test results, wellness recommendations) are not a substitute for professional medical advice. Consult a licensed doctor for diagnosis or treatment decisions.
11. Termination. We may suspend or terminate your access to our Services if you:
Breach these Terms.
Provide false or misleading information.
Use our Services in a way that poses a risk to us, our partners, or other users.
You may stop using our Services at any time, subject to our cancellation and refund policies.
12. Changes to These Terms
We may update these Terms to reflect changes in our Services or legal requirements. We will notify you of material changes via email, our website, or through our Services. Your continued use of our Services after changes take effect constitutes acceptance of the revised Terms.
13. Governing Law
These Terms are governed by the laws of New South Wales, Australia. Any disputes will be resolved in the courts of New South Wales, subject to mandatory consumer protections under Australian law.
